Court relaxes Magaya bail conditions

HARARE - Harare provincial magistrate Vakayi Chikwekwe yesterday relaxed bail conditions for Prophetic Healing and Deliverance Ministries (PHD) leader Walter Magaya, who is facing a rape charge.

Magaya, currently out on

$2 000 bail, had been ordered by Chikwekwe to report thrice every week at CID Law and Order, a condition Chikwekwe altered to once a week.

He was subsequently remanded to September 28 pending finalisation of the matter.

This was after Magaya’s lawyers, Everson Chatambudza and Admire Rubaya, had presented the petition on the basis that the clergyman “has a number of projects across the country and reporting thrice to the police had strained his operations”.

Chikwekwe ruled: “The accused person has been religiously abiding by the order that was imposed by this court as he ... reported thrice a week at CID Law and Order. His work entails him to travel around and outside the country”.

“I see him to be a person who is not a flight risk and, since, by nature of his work he petitioned for relaxation of the said conditions. I hereby grant the request.”

Prosecutor Sabastian Mutizirwa notified the court that investigations in the case were complete and that the docket was now being perused at the prosecutor general’s office.

Rubaya, responding to Mutizirwa, said that they had consented to the postponement with the understanding that onSeptember 28, the State would be ready with a trial date.

He also notified the court of his intentions to apply for release of Magaya’s passport before September 30.

Meanwhile, scores of the popular preacher’s followers thronged the Harare Magistrates’ Court in solidarity with Magaya necessitating heavy presence of anti-riot police.

According to court papers, Petronella Donhodzo Mandaza — a 25-year-old Midlands State University masters in marketing student used to be a congregant at Magaya’s PHD ministries.

Mandaza allegedly accepted an invitation from the preacher to visit him before she was shown around his house.

The court heard that Magaya allegedly left the woman in a room inside the house and returned later, naked.

It was alleged that Magaya then raped the woman once.

It is also the State’s case that after the incident, Magaya gave Mandaza $200 and she later reported the matter to her boyfriend, Elliot Kudakwashe, in July 2015.
