Lawyer sentenced 4 years for bashing girlfriend

HARARE - A Harare lawyer was on Monday slapped with a four-year jail sentence after he bashed his pregnant girlfriend until she suffered a miscarriage.

Emmanuel Samundombe, who ran a law firm in Eastlea, Harare, pleaded guilty to assault when he appeared before Harare magistrate Bianca Makwande but disputed being behind his girlfriend’s miscarriage.

However, Makwande convicted him of physical abuse and sentenced him to 48 months’ imprisonment before suspending 10 months on condition of good behaviour.

Samundombe will serve an effective three years and two months in jail.

In passing sentence, Makwande considered that Samundombe has four children but condemned his disregard of the law since he was a recognised lawyer.

“…only a deterrent sentence would be appropriate in this case and justice will be seen to be done since a life was lost,” Makwande said.

“This court ought to send a message to would-be offenders that domestic violence is not tolerated and that such conduct is unacceptable in modern society.

“As a legal practitioner the accused person was actually aware of the law that he broke but went on to do so because the complainant had disclosed that he had four children with different women to his other girlfriend,” she said.

The complainant is Zvikomborero Choto, 27.

Choto was in a relationship with Samundombe and they lived together.

On June 11 this year, Samundombe returned home and was asked by Choto about his plans of paying damages to her family since she had fallen pregnant.

A misunderstanding ensued between the two over the issue and Samundombe began asking Choto why she had told his other girlfriend that he had four children with different women.

During the scuffle, Samundombe pulled off Choto’s blankets in a violent manner before he locked her inside the house and left the premises.

He returned later that evening and started assaulting Choto before pushing her to the ground.

Choto sustained bruises on her body. She reported the issue to the police.

She was referred for medical examinations that confirmed that she had suffered a miscarriage due to the abuse.

Samundombe was subsequently arrested.
