Warrant of arrest for mayor

MUTARE - Mutare mayor Tatenda Nhamarare faces arrest for failing to appear in court after the Environmental Management Agency (Ema) sued the city’s council over failure to collect refuse.

Magistrate Poterai Gwezhira issued a warrant of arrest against the MDC mayor in his capacity as head of council.

The Mutare City Council (MCC) is being accused of contravening section 83 (1) of the Environmental Management Act Chapter 20:27 as read with section 14(1) of statutory instrument 6 of 2007.

It is the State’s case that on April 15 at around 0900 hours Ema represented by Odette Chipunza noted accumulation of waste at a bridge near Mutare museum, Sakubva flea market and an area near 3 Brigade Infantry headquarters in Chikanga.

According to court papers, council has not been adhering to its waste collection schedule and has not provided adequate bins for proper waste disposal, leading to environmental degradation and pollution.

The court documents also noted that the MCC has been previously issued with environmental protection orders and tickets in an effort to address the need for provision of adequate bins and timely adherence to its waste collection schedule.

This, Ema said, was in the hope that the sprouting illegal dumps in the city would be cleared and not resurface again.
