Prosecutor nails Kereke

HARARE - The private prosecutor who is nailing Bikita West legislator Munyaradzi Kereke was back in court yesterday exposing inconsistencies that emerged in the MP’s closing submissions that were filed off record.

Kereke is being charged with rape and indecent assault after allegedly sexually molesting his wife’s two nieces at their Vainona residence in 2010.

He will be back in the dock on July 11 for his judgment.

Kereke’s main points of defence that were analysed by private prosecutor Charles Warara, include his argument that he was not around during the material time, was no longer in possession of a gun, had the charges fabricated by his political rivals and that the complainants were bitter after failing to extort him.

During his defence Kereke tendered copies of his passport indicating that he had travelled to United States of America at the time that one of the complainants said he had sexually molested her.

However, Warara noted that Kereke had only furnished the court with copies stamped on his alleged departure and entry back into Zimbabwe but did not have an American stamp of the day that he allegedly left that country.

“His defence that he was not at the crime scene but somewhere else first came out in court. His defence is silent on the date he returned,” said Warara.

“He now admits that there is no stamp to substantiate that he was in USA at the material time and says immigration officials there did not stamp because it is common cause that they swipe passports.

“…when he was on the witness stand, prosecution questioned him several times about that stamp and he maintained that it (stamp) was not legible but now he is trying to twist things and bring new evidence.”

Warara also observed that Kereke had coached all his witnesses as they could vividly remember events relating to the dates that buttressed his defence but failed to give answers on any other relevant information.

“The evidence of witnesses cannot be taken as cogent and sufficient because it is not credible.

“In a normal scenario the police was supposed to have called the witnesses for recording of statements but, instead, they were suborned because it is not consistent that they went to give their statements to the police before the accused person had even been apprehended,” Warara said.

He also questioned why Kereke went further refuting a medical affidavit that was compiled following the alleged abuse.

“All these years the accused person did not just sit around doing nothing.

“He even went as far as investigating the doctor who compiled the medical affidavit — which is taken as direct evidence in court and by its nature confirms a fact upon which a matter is founded.

“Everything else would be circumstantial evidence.”

According to Warara evidence relating to how Kereke allegedly threatened Reserve Bank of Zimbabwe security personnel into signing documents that suggested that he had returned his gun on an earlier date ought to be treated as direct evidence in court.

Yesterday ZANOIDS were laughing at Morgiza call him all sorts of names that e.g Mr. Opened zip and little did they ever suspect that in their midist where this guy named Mangengavana. It least the later was dealing with adult women and was not forcing himself on their chests. Icho!

This reporter is biased even if I was not following the story in court. Is it possible that passports are swiped & not stamped in the USA? We need to know. Witnesses are coached on either side. There is nothing new or strange about that. Please report factually. I do not support rapists but please bring a good report

Kereke yu shuld just run,or do a Mzembi thing,get a foreign job n leave the country.Its the clever thing to do.Mzembi ,his ministry doing good,loved by 1st family,n he has made money,bt still runs away from it all .wants to leave the party in disguise of foreign job.thats smart Walter.Yu managed to fool them bt not all.

Mr H Chimeri. If you read the story clearly you will notice that the lawyer said at first kereke said the stamp was not visible and now he has made a u-turn to say it was swiped not stamped. Shows he was lying.

How did he swing into being an MP? Was he not the same Kereke that accused Gono of fake doctrate and was on the verge of exposing some serious zanu pf business. So he got silenced by a polical post? Now we know Mugabe doesnt protect anyone unless they are closer home. What happened to that guys who was imprisoned for forex trading, a guy who used to give Mugabe his suits back in the day but he was held in jail and Mugabe could not bail him out. If Kereke thinks being Zanu will protect him he better think twice. I will not be surprised they are laughing behind his back. Its a dog eat dog party. If he raped his wife's nieces that is a disgrace. Is his wife siding with him? She used to be a decent woman if i remember her well.

What H Chimeri needs to realise is that Tarisai Machakaire is simply telling us what went on. She has not written her composition at all. This is only a report. She is reporting, come on.
