Guta Ra Mwari cleric drags council to court

BULAWAYO - Guta Ra Mwari Church leader Joseph Bakuru Tayali has dragged Umguza Rural District Council to the High Court seeking the urgent release of his personal truck which was impounded while allegedly poaching river sand.

In his founding affidavit, Tayali argued he was forced to file an urgent application seeking the release of his Nissan UD truck since the local authority had no legal basis to hold on to his property.

He argues that the vehicle developed a mechanical fault while in Umguza District while he was carrying sand that had been taken from his farm which is located in Insiza Rural District.

He said despite efforts by his legal practitioners to send a letter of demand, the council declined to release the truck, a development that forced him to seek legal recourse.

“The council has no factual legal basis to hold on to my vehicle. They cannot resort to self-help without a court order and against my will to hold on to my vehicle. Besides, the demand for $50 000 is arbitrary and not supported by any statutory instrument.”
