I'm clean, says Edzai Kasinauyo

HARARE - Suspended Zifa board member for development Edzai Kasinauyo says he is not a match-fixer and is demanding his immediate reinstatement.

Kasinauyo, through his lawyer Blessing Diza of Mhishi Legal Practice, has also given Zifa president Philip Chiyangwa until 11am today to provide all the evidence they have complied or else he will sue the association.

The former Warriors midfielder was on Tuesday suspended together with Warriors assistant coach Nation Dube for their alleged involvement in a plot to fix this month’s 2017 Africa Cup of Nations (Afcon) Group L qualifiers between Zimbabwe and Swaziland.

“The allegations in the suspension letter are false. Our client has never been involved in any match fixing shenanigans,” wrote Diza.

“Despite not having any tangible evidence, the Zifa president and his deputy caused to be held a press conference on March 9, 2016 wherein they published the match fixing falsehoods to the world.

“The article was carried in the daily print media of March 9 and 10, 2016. To cap all this up, the suspension letter carrying falsehoods was copied to Fifa, Caf and the director-general of the Sports and Recreation Committee.

“The publication of these falsehoods have soiled his good name and standing in society and indeed against his peers in the footballing world.”

If Zifa does not avail Kasinauyo’s legal team this information by today, they have threatened to go to court to “compel” to make it available and sue for defamation.   

Kasinauyo’s lawyers also allege their client’s suspension is null and void since the board meeting which made the decision did not follow Article 34 (n) of the Zifa constitution.

“It is common cause that no executive committee meeting was held. Our client who is in an executive committee member was certainly not served with a notice of the convening of such a meeting nor the agenda,” wrote Diza.

According to the Zifa constitution, an executive committee meeting can only be called by the president or half the members of the committee. An agenda must also be sent out to the executive committee members at least four days before the meeting.  

“The ‘executive committee’ which allegedly suspended him invariably became privy to the information forming the basis of the allegation. One assumes that such was discussed before the decision to suspend him was made,” wrote Diza.

“Surely, he should have been given an opportunity to answer to the allegations before the decision to suspend was made. The actions of Zifa amount to a clear disregard of Section 70 of the Constitution of the Republic of Zimbabwe and indeed the principle of natural justice, audi alteram parten.”

These lawyers are full of it. they way they are demanding the evidence is so aggressive that they are displaying lack of knowledge of the fact that if their client is guilty there is need to hide away information until investigations are through. How do they now that that he did not commit the crime. All they have on ttheir books is the evidence that he paid them to defend him. that does not guarantee that they have the license to conclude with all confidence that he did not do it. I would feel ashamed of myself if at all I was saying all this in public. HOWEVER, I am not sure if Chiyangwa is also not playing the "Vote of No Confidence" philosophy game to fix people. We need time to findi out if he is telling the truth. Cheating games are always investigated in ways that are creative. Otherwise you may lose out on the big information that you may need
