Arts council claims attached piano

HARARE - The ongoing court labour dispute between Leeroy Gono, Artistic Director of Masvingo’s Youth Cultural Arts Festival and Masvingo Drama Circle is becoming more complex with the National Arts Council of Zimbabwe (Nacz) claiming that an attached piano belongs to them.

This comes after Masvingo City Council through its Acting Town Clerk at the time turned interpleader with an affidavit claiming that some of the equipment attached by Gono did not belong to Masvingo Drama Circle but that it was Masvingo City Council property.

Gono who used to work for Masvingo Drama Circle was awarded $44 000 as a result of a labour case which arose late 2013 between him and Masvingo Drama Circle.

After Masvingo Drama Circle refused to pay Gono the courts then ordered the sheriff to attach property sell and pay him his money.

The sheriff went on to attach property from Masvingo Drama Circle after which Masvingo Council claimed two speakers, eight fly curtains, one codeless mic and the control, one theatre light, four front home lights, one 13 channel hybrid mixer, one 12 channel hybrid mixer and two hybrid speakers belonged to them.

Just last week Masvingo Drama Circle produced an interpleader with the affidavit claiming a piano attached by Gono belonged to Nacz.

Read part of the Nacz letter dated June 24 2015 and signed by Elavas Mari, the director: “National Arts Council of Zimbabwe confirms that the Steinway grand Piano housed in Charles Austin Theatre is a public asset donated to the theatre for the benefit of the Masvingo community by Mrs Janet Barberis, Chairlady of National Arts Foundation in the early 1970s.

“The National Arts Foundation was created by the National arts foundation Act (Chapter 310), an Act that was repealed and replaced by National Arts Council of Zimbabwe Act, 1985.

“The piano remains the property of National Arts Council of Zimbabwe meants to be used at Charles Austin Theatre by the artists who rehearse there….”

Masvingo Drama Circle operates from Charles Austin Theatre, a facility they are leasing from Masvingo City Council.
