Date set for Gumbura appeal hearing

HARARE - Robert Gumbura, the incarcerated Independent End Time Message founder’s High Court appeal hearing has been set down for August 5.

Gumbura is currently serving an effective 40-year prison term after Harare regional magistrate Hosea Mujaya convicted him on four counts of raping female congregants and contravening the Censorship and Entertainment Control Act.

He filed an appeal at the High Court challenging both his conviction and sentence.

The appeal will now be heard before High Court judges Felistas Chatukuta and David Mangota, after it was postponed indefinitely in January this year when Gumbura sought the services of a new lawyer.

Pending the determination of his main appeal, Gumbura applied for bail at the High Court, a request which was dismissed, prompting him to make another Supreme Court petition.

Gumbura argued in his appeal that the magistrate misdirected himself when he found him guilty and sentenced him to 40 years.

He said that the witnesses were not credible.

“It is clear that the magistrate’s finding that the complainants were credible is plainly wrong,” he argued.

“The honourable magistrate simply took lock, stock and barrel the narrative of the complainants, discarding the explanation given by the appellant and the probabilities.”

He said that the magistrate did not critically examine the allegations raised by the complainants.

“In this regard, the magistrate was regrettably swayed by non-legal considerations and passed a moral judgment. Most fundamentally, the honourable court was obligated to critically examine each allegation of sex in the surrounding circumstances.

“The judgment of the magistrates’ court cannot withstand scrutiny on appeal,” he said.

During his bail application, prosecutor Editor Mavuto said Gumbura had no prospects of success on appeal.

Gumbura is also set to stand trial on July 20, following allegations of masterminding food riots at Chikurubi Maximum Security Prison and participating in a foiled jail break.

Mr Gumbura was a preacher and a Pastor in the End Time Message who abused the name and deity of God. Gumbura bedded married women and girls young and old in his Church. He committed adultery to be specific. God punished David and he also deserves God's punishment either way. What the bible defined as 'wolf in sheep skin' could best describe Mr Gumbura's way of life and gospel in his church. He preached truth and lies to further his schemes against faithful brothers and sisters without them suspecting. Everyone in the Church never believed he was capable of doing the 'dirty' life as a renowned preacher of more than 20 years experience until 2013/2014 era. God forbid, He did not want him to proceed any further, destroying families and the lives and future of young girls. For the sake of the girl child, if the courts grants him bail pending appeal, this man should be under very strict conditions. The man is capable of killing and doing unbelievable harm to the 'rebel' members who exposed him left, right and centre through the legal system. We should not condone such behaviour in our society where a man does what he wants with congregants in the name of God in Zimbabwe. What the country got to know about Gumbura through the Courts is nothing compared to what he actually did and claimed pompously and rudely to have done and enjoyed as recorded in most of his church service sermons which were taped and records (soft copies) are still with the Church secretaries (men and women) at 6 Helena Close, Marlborough. Most congregants will live in fear and greatly traumatized to say the least, if ever this man who masqueraded as a Preacher, finally is granted bail. May God have mercy.

PASTOR GUMBURA MUST BE RELEASED Gumbura has no case whatsoever. It is true that he bedded women, but he was not forcing them. He would propose love and so would be loved. There must be some reason for his incaceration other than this offence. These are trumped up charges for this man. Some people want him to remain in Prison merely out of jealousy. The only advice I would like to give Pastor Gumbura is to leave married women alone. While is not a criminal offence to bed a married woman but socially and morally it is not good. I also would like to kindly ask him not to abuse Young Girls whom he has no intention of marrying. However if he wants to marry 1000 wives, let him go ahead as long as he is able to satisfy them and he is in agreement with them. Zanu PF should leave him alone, Gumbura should be released.

I never thought this is what I was signing up to. I think about all the lies that I said to nail pastor Gumbura. If things could be reversed, I would honestly reverse what I said for the nation to know the truth. I at times wake up at the middle of the night because of the night mares I'm having for what I did. Zvakangowomawo hazvo. dayi vaingoburitswa havo. kana vachizosungwa nedzimwe vosungirwa idzodzo havo.
