Madzibaba Ishamea jailed 4 years

HARARE - Madzibaba Ishamea Mufani trembled in court yesterday after being jailed for four years over public violence.

Harare magistrate Milton Serima sentenced the cleric to five years’ imprisonment before suspending one year on condition of good behaviour.

Mufani had pleaded with the court to consider a non-custodial sentence because he has seven children to fend for.

In mitigation he said: “I survive on building and have a big family to cater for. If sent to jail today my children are going to starve your worship.”

When the court asked Mufani if he had any savings, the cleric responded that he only had 2 rand.

Serima noted that witnesses’ evidence had managed to prove that Mufani was present at the shrine when the offence was committed.

He said Mufani took advantage of the commotion to dispute his presence on the day.

“You unlawfully and intentionally participated in the offence and as such you are found guilty as charged,” Serima said.

“You should have led by example and not instigated violence as an ordained man of God.

“A custodial sentence will send the right message and deter potential offenders.”

Prosecutor Fransisca Mukumbiri said Mufani’s degree of moral blameworthiness was very high.

“Instead of calming his congregants, the accused led an attack in which several people were severely injured,” she said.

“The police ought to be respected but you overlooked that and ridiculed them.

“The force’s name was tarnished and sanity should be restored, otherwise police will never be respected by the public.”

Mukumbiri proved that on May 30 last year, an entourage led by Archbishop Johannes Ndanga that included police officers and journalists was beaten up by the Vapositori after Ndanga announced he was shutting down the church for violating children and women’s rights.
