Renewal team takes Parly dismissal to ConCourt

HARARE - Twent-one legislators who were booted out of Parliament for ditching the MDC to form the United Movement for Democratic Change, have filed a Constitutional Court application seeking to nullify their dismissal.

The 21 had been elected into office on a Morgan Tsvangirai-led MDC ticket.

However, the group later formed a splinter group, which resulted in Speaker of Parliament Jacob Mudenda expelling them from the august House.

In the application, the politicians cited Mudenda, Parliament of Zimbabwe, President Robert Mugabe, Zimbabwe Electoral Commission chairperson (Zec) Rita Makarau and Zec as respondents.

Those that were affected by the expulsion are, Tendai Biti (Harare East), Willias Madzimure (Kambuzuma), Paul Madzore (Glen View South), Solomon Madzore (Dzivaresekwa), Lucia Matibenga (Kuwadzana), Samuel Sipepa Nkomo (Lobengula), Roselyn Nkomo (Tsholotsho), Reggie Moyo (Luveve), Moses Manyengavana (Highfield West), Albert Mhlanga (Pumula), Bekithemba Nyathi (Mpopoma), Settlement Chikwinya (Mbizo), Arnold Tsunga (Chikanga-Dangamvura), Gladys Mathe (proportional representation), Judith Muzhavazhe (proportional representation), Evelyn Masaiti (proportional representation) and Gorden Moyo (Makokoba).

Also recalled from the august House are senators Sekai Holland (Chizhanje), Rorana Muchihwa (Chikomo), Watchy Sibanda (Matabeleland South) and Patrick Chitaka (Manicaland).

The 21 claim that their fundamental rights to equal protection and benefit of the law was infringed by the decision to expel them from Parliament.

Strategically it was a silly move by MDC-T to get them expelled from parly and an equally a silly move by Biti & his renewal team to have claimed to have expelled Morgan and team and then go on to form UMDC. Unless they can argue that UMDC is like Patriotic Front of the 70s, i cant see their court challenge having merit.

Do you honestly think Bit and Co were doing what tsvangirai tells them to do? Their being in parliament was not saving any purpose because they are opposition members, they were not taking what tsvangison & co will have agreed beforehand. Let them contest and see if they will win- fools

I see nothing wrong with the decision taken by MDC-T to expel those Rebels. Imagine you go to war against your rivals then suddenly three of your group starts firing at you, killing some of your comrades. What would you do.Would just watch and say they are good.Common sense must transcend above all kinds of jealous.
