Jailed conman seeks freedom

HARARE - A 27-year-old graphic designer jailed after being found in possession of a fake police identity card bearing his particulars, a pair of handcuffs and a pistol, has approached the High Court seeking to be freed on bail.

Taurai Madziwa is challenging Harare magistrate Tendai Mahwe’s 12-month prison term.

Madziwa was convicted on charges of possessing articles for criminal use.

The convicted  man, who hails from Glen View, was employed by Zerox Printers as a graphic designer.

Madziwa was arrested following a police tip-off in November last year that he was masquerading as a police detective. He claimed that he was stationed at Harare Central Police Station’s homicide section.

Acting on the information, the court heard that police officers conducted investigations, leading to Madziwa’s arrest at Batanai Gardens in Harare’s Central Business District.

The police officers took Madziwa to his place of residence, where they conducted a thorough search, leading to the recovery of a fake Zimbabwe Republic Police identity card, a pistol and a pair of handcuffs.

Madziwa, through his lawyer Meme Zvimba, has since filed an application for bail before the High Court.

“It is … humbly submitted that the court a quo erred when it convicted the applicant and failed to take into account that although the items and or articles were recovered from his house, he did not commit any offence and or

intended to commit same,” Zvimba told the court in the application.

She said the items recovered from her client had been left at his house by a friend.

High Court Judge Garainesu Mawadze, deferred the hearing of the bail application to tomorrow, after prosecutor Sharon Fero told the court that she was still to respond to the application.

    Nonsense why having the those particualrs without any intetion of commiting crime. 12 months isn't enough. He must spend 5 years in jail. vanhu ivava vakaipa.
