Ex-Studio 263 actor acquitted

HARARE - A Harare magistrate has acquitted former Studio 263 actor, Tafadzwa Gregory Hillary Tandi, who was being accused of fleecing a couple of $23 500.

Tandi was charged with fraud after reportedly lying to the couple that was planning a wedding that he was a choreographer employed at Cresta Lodges.

He also allegedly claimed that he was the wedding planner for Bona Mugabe’s A-list wedding.

Magistrate Elijah Makomo concurred with Tandi’s argument that the complainant had brought a civil matter to a criminal court.

“The complainant was bound by a contract,” Makomo ruled.

“Poor performance or the accused person’s failure to perform according to the standards of the contract does not amount to misrepresentation thus the matter does not meet the essential elements of fraud.

“It is therefore a civil matter.”

Makomo said the complainant actually met part of the agreement by giving Tandi $20 000 as part of the contractual obligation.

Prosecutor Gorge Manokore alleged that Tandi approached the couple, which was preparing for a wedding sometime in March last year.

The complainants engaged Tandi and were charged $1 000 before receiving a quotation of $30 000, the total wedding cost.

Tandi did not do what he promised, the court heard, prompting the complainants to report the matter to the police.

Tandi then returned $3 000 to the complainants through EcoCash after realising that the matter had been reported to the police.
