Toxicology report stalls DJ Munya trial

HARARE - The State is not yet in possession of toxicology and histology reports needed in Munyaradzi Milimo (DJ Munya)’s murder trial, a magistrate heard yesterday.

DJ Munya’s trial has been stalled because of a pending histology report which looks at body tissues and organs through the examination of the microscopical architecture.

The results are expected from a South African pathologist together with the toxicology report looking at the impact that the alleged toxic materials had on the deceased’s health.

Lucky Mawuwa, DJ Munya’s lawyer, reminded the court of the previous magistrate’s directive to remove accused persons from remand if the State failed to furnish them with a trial date.

When DJ Munya and his accomplices Taurai Jani and Mohammed Matare appeared in court on December 31, magistrate Tendai Mahwe gave the State one last chance to put its house in order. DJ Munya stated that he wanted to be removed from remand during yesterday’s court appearance.

Prosecutor Sharon Mashavira produced letters from the Prosecutor-General’s office and South Africa to prove that the State was still seized with the matter, and urged the court to remand the matter further to February 13.

According to Mawuwa, the letter from South Africa showed that there was no progress or cooperation on the issue of toxicology and histology results.

Presiding magistrate Milton Serima will rule on the issue today.

Allegations against the trio arose after Tinashe Magorimbo died due to suspected poisoning.

This was after he allegedly failed to pay Milimo $5 000 “compensation” for having an illicit affair with his wife.

The court heard that Magorimbo allegedly gave Milimo a part payment of $1 000 through Jani and Matare in February last year.

It is alleged Magorimbo later became evasive, prompting Milimo to enlist the services of Jani and Matare to force him to pay.

Magorimbo went missing in May, before his body was later found outside his flat by his wife on May 18, naked with both hands tied with a rope.

He later died at West End Clinic, where he had been admitted in the Intensive Care Unit.
