Rushwaya can hang - Zifa

HARARE - The Zimbabwe Football Association (Zifa) has rubbished an ultimatum by former chief executive Henrietta Rushwaya demanding reinstatement and outstanding salaries amounting to $158 000 following her dismissal four years ago.

In a sharp-worded response to her lawyers yesterday – Zifa dismissed Rushwaya’s claims as baseless – insisting that the ban on her stands, adding that the association did “not owe her a cent.”

Rushwaya was fired by Zifa in 2010 for her alleged role as the architect of Zimbabwe’s much publicised match-fixing scandal, known as Asiagate.

She was later handed a life ban by Zifa from all football activities alongside 14 other officials and players, although she has been fighting against the ban and recently defied it by officiating at last week’s Gushungo Victory Cup final between Dynamos and Highlanders – where she was one of the tournament organisers.

Lawyers Chinyama and Partners Legal Practitioners wrote to Zifa CEO Jonathan Mashingaidze last week demanding that their client being reinstated within 48 hours.

The lawyers also ordered the local football governing body to pay back-dated salaries within seven days, further compounding financial woes of the beleaguered association, which in addition to reeling under serious debts reported to be over $5 million, has also lost labour disputes against sacked employees resulting in the attachment of office property by the Deputy Sherriff.

The letter to Zifa by Rushwaya’s lawyers was also copied to Fifa secretary-general Jerome Valcke.

Zifa, however, came out fighting yesterday, with the association’s lawyer Ralph Maganga writing back to Chinyaman and Partners to dismiss her claims.

“Our instructions are that your client is not owed a cent in terms of salaries for the period she was an employee of Zifa and yours is fully aware of that position but has decided just to denigrate the name of the FA. Zifa does not owe your client $158 000 in salary arrears or any amount for that matter,” read the correspondent.

“Further, you client was banned by Zifa Adhoc Dsinplinary Committee and this case is unrelated to the labour one which she did not pursue when she was dismissed and by now, has since prescribed.

“The claim for damages has no legal basis because the contract of employment was lawfully terminated after the employer constituted a disciplinary hearing which found her guilty and had her dismissed.”

Rushwaya and the other individuals slapped with bans want the sanctions lifted on the basis that world football governing body Fifa has not endorsed them.

But Zifa says Fifa’s lack of action on the matter was of little significance.

“As for the life ban, Fifa refused to extend the ban globally so that it was to have worldwide effect but the local ban remains effective. Your client’s ultimatum is promptly ignored.”

Who is behind this woman? The devil is not supposed to be powerful. She brought endless sufferance to innocent souls, players and coaches are rotting in their backyards after she initially crafted the Asia-gate scandal in a bid to tarnish Zimbabwean football forever, and now that she did not succeed she wants to haunt Z.I.F.A. again! If the truth is told,the whole Asiagate saga was a farce,Gumede was behind all this rubbish with the intentions of having his guys in control of football,just look at the chaos he brought to Highlanders.Rushwaya will win the case ,as for Zifa please you CEO leaves a lot to be desired,ZIFA has always lost case then for it to fool itself on this one is something else.To some of us the writing is already on the walls and Rushwaya will bounce back.
