Jabulani Sibanda released on bail

HARARE - Ex-war veterans’ leader Jabulani Sibanda has been freed on bail after being held for five days on charges of insulting or undermining the authority of the president.

Magistrate Vakayi Chikwekwe released Sibanda on $400 bail after noting the State was struggling to prove that the 56-year-old was not a suitable candidate for bail.

As part of his bail conditions, Sibanda was barred from interfering with the Zanu PF’s congress, not to mobilise anyone to march to any State institution, reside at 6337 Nkulumane Bulawayo and surrender his passport.

“The State case would have been strong if the State showed that accused person has attempted to tamper with witnesses,” Chikwekwe said.

“The investigating officer told the court a clip which is part of the evidence was tampered with indirectly by the accused person but failed to substantiate his assertion. Therefore, on such grounds, accused cannot be deemed unsuitable for bail.”

The State, led by prosecutors Jonathan Murombedzi and Oliver Marwa, argued that bail would trivialise the offence and threaten public safety.

Murombedzi said there was high likelihood that Sibanda would mobilise people and cause chaos at the Zanu PF’s congress.

The matter was also referred to the Constitutional Court (Con-Court) after Sibanda’s lawyer Sobusa Gula-Ndebele indicated that the charges preferred against his client infringed on his constitutional rights to freedom of expression.

Magistrate Chikwekwe granted the application, saying the lower courts needed guidance from the superior courts on cases of such nature.

“The charge by the State has the effect of infringing on the rights and freedom of the accused, which rights have been deemed fundamental by the constitution,” Ndebele said.

“Every person has the right, at law, to seek, receive and communicate ideas and other information.”

Allegations against Sibanda arose on October 27, at Hebert Mine in Mutasa.

He allegedly delivered a lengthy speech alleging that President Mugabe and his wife Grace were planning to topple Vice President Joice Mujuru and replace her with the First Lady.

He further said he was not prepared for such an arrangement because power is not “sexually transmitted.”

Amongst severally other foolish declarations this fool, Sibanda, declared that "power was not sexually transmitted". He then did not tell us how he wants it to be transmitted; and under what authority himself should dictate the transmission of power? The last time we checked, this same hoodlum was killing, maiming and harassing innocent people to daring to transmit power democratically. So, in that vein, it is clear this thug has since surrogated himself the authority to dictate how power should be transmitted in Zim. In short, Jabu sees himself as the President of the dear Republic @ the moment. Hence, ladies & gentlemen, if that is not treason, then what is treason in Zim?

Guaranteed, as soon as Jabulani Sibanda gets the privilege to speak to any media person, he will inform us of his undying love for the President and ZANU PF. The very same organisation led by the same person that killed thousands of his kith and kin in Matabeleland and Midlands, the same who had him incarcerated for expressing his own views about the goings on in his beloved party. Some call it bootlicking, it is actually a condition that needs treatment and it's called the Stockholm's Syndrome. Many that I know need a cure including Mutasa and Gumbo.

Mr Sibanda goes back to Nkulumane, to stay among the same people he terrorised. I hope they'll forgive him otherwise he is doomed. The farm in Nyamandhlovu will be repossessed. So sad. Jabu welcome to Zanu PF orientation. I thought when you campainged for the emperor viciously and violently suppressing the right of the people to express themselves freely by means of voting according to their conscience you knew what you were doing. You reap what you sow. Wish they take you back in and charge you with treason and give some good years in prison. Atleast you will get the chance to explain Zimasset in prison to your fellow inmates from who have been incarcerated due to the same made up frivolous charges that Zanu uses to suppress dissent.
