Gumbura seeks High Court bail

HARARE - Jailed Independent End Time Message founder Robert Martin Gumbura has filed an application for bail pending appeal at the High Court after a Harare magistrate ruled that he had no jurisdiction to hear the matter.

Gumbura is currently serving a 40-year prison term. He was convicted by Harare regional magistrate Hosea

Mujaya on four counts of rape.

The 57-year-old pastor initially made an application for bail before Mujaya.

Bail applications for serious offences fall under the High Court’s jurisdiction.

Prosecutors at the Harare Magistrates’ Courts said that Gumbura has little prospects of success on appeal.

“In view of the lengthy custodial sentence that was imposed coupled with the fact that accused is yet to stand trial on another similar offence in due course, this is sufficient inducement for applicant to abscond once he is released,” prosecutor Jonathan Murombedzi warned.

He claimed Gumbura was a flight risk, considering that he has other church branches in South Africa and the United Kingdom.

However, on the other hand, Gumbura’s lawyer Rekai Maposa told the court that the conviction and sentence

was a miscarriage of justice, adding her client was not a flight risk.

The controversial pastor has 11 wives and 30 children. He made headlines after openly claiming that he desired to have 100 children.

The State closed the rape case on December 20 last year, after leading evidence from 12 witnesses.

Meanwhile, Gumbura is still to stand another rape trial, following claims by a South Africa-based woman that he raped her.

The woman failed to appear in court on December 9 last year, when  the trial involving the other women kicked off at the Harare Magistrates’ Courts.

The matter is set to begin on March 31.

This is the first time I have ever entered a response on this platform. I am shocked at Gumbura's attitude and the attitude of his advisers if he has any. Does he really think that he can get away with trivialising such acts! May he rot in jail!

@Justice: Don't ever lie about whether you are first to submit a comment. What you have as evidence is all hearsay. You are not a credible witness Justice. I want to tell you that the congregants for Gumbura were over 500 people and only 7 people left the congregation after completing their skimming project against the Pastor and after enjoying all church spiritual, social, financial benefits and familyhood. What they told caughts are twisted statements to suit their false allegations. No matter what the whole world can say. The only congregants who will congregate soon under Apostle Gumbura will show you that Gumbura NEVER raped anyone. Yes, the complainants and some of their husbands are angry but its NOT rape but a spiritual matter of rebelling against church correction and being put in the hands of satan per 1 cor 5 v1-5 which they are fight back using some 3 females (now married with children) who were never married into Gumbura family at different widely spaced periods of time. The other 4 females (one a married) had no sex with Gumbura and three (3) were operating on behalf of Linda Magunde in Canada. Why can't you ask the congregation, do you think we really hurt these 7 people. No No No!! They Lied all rape cases. I don't care what you claim, but the congregation know sex and abuse. They was no abuse, those girls willingly gave their bodies for different favours and reasons. There was no intimidation.

Vindicated! What he did is not supposed to be done in church. if he is a man of God as you say he is, don't fight for him God will fight for him like He did for Paul and Silas, Daniel and friends. the angels will come and take of the chains. Jesus is still the same yesterday, today and forever. Don't fight for the men of cloth, God will.Tell Gumbura not to apply for bail from courts but to God!Surely if his case is correct, our God should intervene ,that is if we share the same God..

I still one of those who fell the miagistrate erred, either he has a relative whose wife cheated with Gumbura (I say cheated not raped) because all those women who testified showed they agreed to the sex escapades. The only reason is that they are now aligned to another church member who broke away and they started the crusade to destroy Gumbura. We try to accuse him just because he has 11 wives but how many people in Zimbabwe are poligamists and going to church for that matter. yes some use Solomon and Jacob for their polygamous attitude but what is their difference from pastors who abuse Malachi when they demand tithes? You can use a verse to your advantage but that cannot be construed as rape. Goven a rational judge Gumbura can do with community service of abusing church facility to have sex not rape.
