Hubby sired 3 children out of wedlock

HARARE - A Harare woman was shocked in court yesterday after her husband produced birth certificates for three of his children born out of wedlock.

Lameck Kadzere produced birth certificates after his wife Blantina hauled him before the Harare Civil Court claiming $200 in child support.

Blantina told the court that her husband deserted her after she was involved in an accident.

She told magistrate Vongai Muchuchuti that she cannot do anything for herself and needs money to support the family. She said she was shocked to hear that Lameck was living with another woman yet they were married under Chapter 5:11 of the Marriages Act.

“Lameck is a truck driver and earns a lot of money. I cannot do anything on my own, my Grade Seven child does everything for me including taking me to the toilet,” said Blantina.

“I last saw him in 2010 when he deserted me after I was involved in an accident. This is my first time to see him in three years,” she said.

Kadzere did not deny his wife’s allegations but said that he had three other children who need his support before producing their birth certificates.

“I have another wife and three other children but let us talk about maintenance issue here not my private life, ” Kadzere said.

Magistrate Muchuchuti told Kadzere that the court considers his first family not his adulterous family since he was legally married.

She ordered him to pay $120 as maintenance for the children.

Kkkkkkkkk, the magistrate lost it here. Magistrate, are you serious? Are you saying children born out of wedlock are not people or human beings? I would have wanted to know your own status in terms of this subject. There is a good chance that you were born out of wedlock as well, and shall we not take your judgements as valid, since the courts only consider people from the first family. Kkkkkkkk. I wanted to see the passes of this magistrate at school and on her training. And obviously I can tell that the magistrate does not have o level Maths. otherwise he would have learnt logic and reasoning.

I am not a fundi in this field. I think the magistrate was dead rite in the sense that when one is legally married one is not suppose to have an affair let alone to sire children the reason these children are refered to as born out of wedlock. By reducing the maintenance fees to 120 . The magistrate also took into account that even though these children were born illegally so to speak they deserve the support of this man, sending a message that since he was legally married he must have terminated the first marriage first before he could enter into another marriage .ie separation first then file a divorce before he can marry another wife. like l said kuti l am not a fundi Danai usandituke hako kuti l dont have O level maths. I have only expressed an opinion which may be correct or wrong.

Stupid man, should have been asked to pay more. How can he desert a disabled first lady with children. He should have talked it over with wife if he needed the services of another woman hopefully services which the first wife was unable to provide due to her condition.

tk - 15 January 2014

TK is right coz you dont have to desert yor wife coz of her disablity. sit down and talk about the issue

elimond - 16 January 2014

Yes the man may have acted inhumanely in leaving his wife after an accident but to punish innocent children born out of wedlock is also inhuman. The magistrate should have seen to it that both sides get a fair share of the man.s upkeep. I pfungawo dzangu idzi
