Harare businessman in property dispute

HARARE - A Harare businessman, Hanif Allana is entangled in a property wrangle with ex-lover Audrey Aisha James, who  claims the tycoon used fake documents to sell her Avondale house.

In the High Court application, James and Uniress Investments (Private) Limited, who are the applicants, cited Moosa Allana, Mohammed Ali Allana, Sevter Investments (Private) Limited and chief registrar of deeds, companies and intellectual property as respondents.

According to a letter written by the chief registrar of companies, identified as M Chakanyuka, addressed to the court, the Allanas used fake documents to effect change of directorship of the company. Chakanyuka said the documents were fake because the receipt numbers endorsed at the foot of the documents were not available in their records of receipt books used during that period.

He further said the signatures were forged.

In her court papers, James through her lawyer Kudzaishe Gama, claims her daughter Ammara Anif Allana was fraudulently dropped as a director from the company.

With a teenage daughter out of the 20-year romance with the trader and Elite Car Hire owner, the woman found herself destitute — with her personal belongings and furniture strewn all over the northern end of Avondale’s Kent Avenue.

The Allanas purportedly sold the $600 000 disputed property wholly-owned by Uniress investments to Servter Investments (Private) Limited, a company owned by Palestinian Salim Abdullah Siam.

In their response, the Allanas said James had no right to appear on behalf of Ammara.

“The first and second Defendants (Moosa and Mohammed) will lead evidence to show that first Plaintiff (James) and her daughter duly resigned as directors of Uniress Investments (Pvt) Ltd and further also agreed to appoint first and second Defendants as new directors,” the Allana’s wrote in court papers.

They claim they were properly appointed before selling the property to Sevter Investments.

They told the court that James’ eviction was above board.
