Man jailed 10 years for wilful HIV transmission

HARARE - A 22-year-old Mhondoro man will spend the next 10 years in prison for raping and intentionally infecting a juvenile with HIV.

Harare regional magistrate Hosea Mujaya yesterday sentenced Foster Kaseke of Matienga Village, Mhondoro, to an effective 10 years behind bars.

Mujaya said Kaseke had committed a serious offence that can only be justified by a jail sentence.

Prosecutor Sharon Mugebe proved that on August 2 this year around 8pm, the girl’s mother travelled to Harare and left her alone.

Kaseke went to the 14-year-old girl’s house and entered her room while she was doing household chores.

He tripped the girl, forcibly removed her clothes and raped her.

The court heard the teenager did not disclose the incident until she noticed that she was developing genital sores on August 15.

She then told her grandmother Stella Mukarati who resides in Nyamweda that she had been raped by Kaseke and was developing genital sores.

Mukarati informed the girl’s mother about the rape, before proceeding to Chivero Clinic where tests were done confirming she had been infected with a sexually transmitted disease.

A police report was filed at Chivero Police Station, leading to Kaseke’s arrest.

The girl later underwent three HIV tests which indicated that she had been infected with the virus.

In his defence, Kaseke said he believed that the girl was over 16 years and mature enough to engage in a relationship.

He said they had been in a relationship for three months and that on the day in question, he was invited to the girl’s residence where he was served food before indulging in sexual intercourse.

Kaseke also said the girl did not bleed or scream during sex, signifying she was not a virgin and that the act was consensual.

He also said on one occasion, they had “made love” in a tuck shop around 10am with the door open to detect any suspicious movements.

It's sad that the young teenage girl got infected with the deadly virus at such a tender age. It is however evident that the two were an item and the girl only thought of a safer way of revealing her tragic situation by incriminating the dude.
