Court orders businessman to pay $390k debt

HARARE - A High Court judge has ordered a Harare businessman to pay over $390 000 owed to fertiliser and chemical manufacturing company, ZFC Limited.

Justice Lavender Makoni last Friday issued a summary judgment against businessman Patrick Makava and his PM Manufacturing Private Limited company, ordering the two — cited as respondents in court papers — to pay $390 250 owed to ZFC.

The debt incurred between December 2011 and April last year, spilled into courts after Makava and his company failed to honour the terms of the agreement.

The company, according to court papers, failed to pay for the fertiliser and chemicals before the agreed date of April 13, 2012.

According to court documents, Makava signed an acknowledgement of debt on behalf of the company, admitting the firm owed ZFC $400 250.

The papers further claim Makava’s company only managed to pay $10 000 towards the servicing of the debt, leaving a balance of $390 250.

ZFC was represented by Advocate Thabani Mpofu, while Makava and his company were represented by Advocate Fadzai Mahere.
