Tsvangirai demands fresh election in 2 months

HARARE - MDC leader Morgan Tsvangirai has demanded a fresh election in the next 60 days, declaring President Robert Mugabe’s win as “null and void”.

In the application, Tsvangirai cites President Robert Mugabe, chief elections officer Lovemore Sekeramayi, Zimbabwe Electoral Commission (Zec) and its chairperson Rita Makarau as respondents.

The disputed election saw Mugabe winning by 61, 09 percent, while Tsvangirai got 33, 94 percent.

The party’s spokesperson Douglas Mwonzora yesterday told journalists that the request for nullification of the results was based on 15 grounds.

“These include bribery of the electorate by some of the contesting candidates, we saw doling out of foodstuffs, kitchenware that is not allowed in terms of our Constitution” Mwonzora said.

According to the application, the election was marred by a duplication of names on the voters’ roll, abuse of the special voting system and a rampant misuse of voter registration slips, among other issues.

“The 1st Respondent’s wife Grace Mugabe throughout the campaign period dished out truckloads of foodstuffs — including maize meal, sugar beans, cooking oil and salt — at rallies addressed by 1st Respondent. This was designed to buy the voter and influence voting patterns,” the application reads.

Tsvangirai accused the Zimbabwe Broadcasting Corporation of acting in a partisan manner, before, during and after the election.

He said his party was not accorded equal State media coverage, rendering the playing field uneven.

“Through this election petition and evidence which will be led at the trial, I respectfully submit that the first respondent (Mugabe) was not duly elected, owing to the numerous corrupt and illegal practices and other electoral malpractices,” Tsvangirai said.

Soon after the filing of the application by the party’s lawyer Chris Mhike, Mwonzora said: “We were vindicated by the findings of Sadc, that the election was peaceful and free but not fair. Our Constitution Section 155 says the election must be free, fair and peaceful.

So one element is missing and that has been confirmed by Sadc.

“We are also dealing with the issue of the voter registration slips, the issue of the assisted voters, the intimidation, the involvement of security services in this election. In terms of chapter 11 of the Constitution, security services must not be allowed to dabble into politics and also the involvement of the traditional chiefs in terms of chapter 15 of our Constitution that is not allowed.”

Mwonzora said that the irregularities witnessed in the July 31 election vitiate the poll.

Mwonzora told reporters that his party will not be deterred by the court’s position in terms of impartiality.

“It’s a case of both national and international importance and we hope that the judges of the Supreme Court will deal with this matter as an election petition and will pay particular regard to Section 85 of the Constitution and that section says that the judges must not be constrained by technical issues, they must look at the substance of the case,” Mwonzora said.

He said his party was going to proffer both oral, physical and documentary evidence to prove its case.

Meanwhile, Tsvangirai has also filed an urgent chamber application demanding Zec to supply him with material and information that he needs to use in challenging the presidential election result.

“I am aggrieved by the outcome of that election and am challenging the outcome of that election in the Constitutional Court. For the purposes of preparing and filing my election petition, I intend to study and analyse the election material used in the election to partly support my contention that the election conducted on 31 July 2013 produced an undue return,” Tsvangirai said.

The other thing mugabe was sure of was to rush the elections but let me ask again frow all positive zimbabweans please analyse for me what were the achievements of the SADC appointed facilitating team ,if I can ask and for the Election road map what is it that they achieve .The only thing so far was the new constitution of Zim but what else, you people you were not serious never be intimidated if they say you are interfering with our judicial system to whom these patsan concourt judges reports to.I say all the loopholes and rigging was as result of you working in gvt you were suppose to negotiate everyting when you are not in GVT you people we thought you are educated but you are not where was your check list.You went into this election without a check list of compliance other ways it was better you were suppose to bycott.In next elections in future if you did not have a check list of compliance you will not win but Bob has one check list thats why every time he has better hand. But is 60 days enough time to sort out the voters' roll, register people who were denied registration etc. I have suggested in an opinion piece that hasn't been published that the GNU comes back to prepare for the election. A three months preparation is in order.

Surely, if if you want your win to be easily acceptable to the whole world, why not allow equality as required by the electoral reforms? Ex-Prime Minister Tsvangirai's case will certainly fail as evidence presented will be countered effectively. Why demand sixty days to another election? For rigging? For his western backers to strategise for his party? Telling it like it is: For-Prime Minister Tsvangirai will not succeed and even most within his party's leadership know it are in fact plotting his political demise. Even GIFT PHIRI who wrote that Tsvangirai would win by 61 per cent is bound to agree that Tsvangirai is on his way out.

ZPF is, indeed, a party of blood and violence. They lose an election, they become violent. When they win an election, they become violent as well. Win or lose, innocent people a victimized all the same. Then they have the courage to call themselves 'the people's party'. I just don't understand what they want civilians to do. Maybe inwardly they know that they have been losing elections ever since independence in 1980.
