Stop ballot recount: Samukange

HARARE - Mudzi South National Assembly winner Jonathan Samukange has given the Zimbabwe Electoral Commission (Zec) an ultimatum to withdraw its directive for a recount of the votes cast in the area.

Zec issued a directive that it will recount the votes following a request by losing Zanu PF candidate Eric Navaya.

The commission’s chief elections officer Lovemore Sekeramayi said the recount will be done in accordance with provisions of the Electoral Act.

But, Samukange, who contested as an independent, said the recount was “unlawful and illegal”.

“The commission has ignored the provisions of Section (70) of the Electoral Act, which relates to custody and disposal of ballot and other papers,” said Samukange’s letter to Zec chief Rita Makarau.

“The boxes were sealed on the 31st of July 2013 and the 1st of August 2013 and we have it on record that you do not have a court order authorising opening of the sealed ballot boxes.

“A recount therefore would be in daylight disregard of the law. A recount would necessitate a reopening or tempering with the seals of the ballot boxes which will be unlawful and illegal in the absence of a court order.”

Samukange said he will move to interdict the recount.

“Unless I hear from you by no later than 1000hrs on the 5th of August 2013 (today) that you have revoked your unlawful and illegal order, I have no choice but to approach the Electoral Court on an urgent basis for an interdict and you shall be liable for costs,” Samukange said.

There was never going to be a recount. ZEC had blundered in accepting the request for a recount. Those sealed ballot boxes contain "a contagious" disease that "observers" must never see. I bet there would have been shocking discoveries in those boxes. The revolutionary party in its wisdom, must have realised the folly of demanding a recount.... Jonathan's challenge is just tactical withdrawal
