MDC approaches Sadc over 'illegal' poll

HARARE - Prime Minister Morgan Tsvangirai’s MDC has formally written to regional bloc Southern African Development Community (Sadc) for recourse saying the July 31 poll was “illegal” as it was foisted on Zimbabwe by President Robert Mugabe in utter disregard of the rule of law and international sense.

MDC secretary general Tendai Biti told a news conference yesterday that Mugabe’s unilateral declaration that general elections would be held on July 31 ignored the role of the legislature which was supposed to pass Electoral Act amendments.

Parliament stood dissolved on June 29.

Mugabe used his presidential powers to pass the amendments to the Electoral Act even without the consent of Cabinet.

Biti, a lawyer by profession, said they had highlighted to the regional bloc that several pieces of legislation such as the Access to Information and Protection of Privacy Act (Aippa) and the Public Order and Security Act (Posa) had to be aligned to conform to the new Constitution before the holding of crunch elections.

“The holding of elections in light of the fact that resolutions made in Maputo were not fulfilled renders the polls meaningless,” Biti told reporters at the MDC HQ Harvest House.

“Sadc should know that we could have realigned the laws, we have written to them to review this situation.

“The Electoral Amendment was passed without going to Parliament and the outcome is, we are going to have an illegal election. The law could have been passed but a rogue State has ignored the rules of international law and Sadc. Sadc should meet and determine whether we can have a legal election.”

On June 15 in Maputo, Mozambique, Sadc heads of State passed resolutions compelling Mugabe to among other things publicly call service chiefs, who have in the past made threats to subvert popular will, to order, respect the rule of law and also effect media and security sector reforms before elections.

The 15-member bloc also tasked Zimbabwe coalition leaders to approach the courts and seek an extension of the July 31 poll deadline.

Biti said Mugabe’s application to the court, as directed by Sadc, was weak and designed to lose and railroad the country into an election without the prerequisite reforms as demanded by the other half of the coalition. 

Biti indicated that his MDC and the other MDC formation led by Industry and Commerce minister Welshman Ncube, is still in touch with South African President Jacob Zuma’s facilitation team that includes Lindiwe Zulu who the 89-year-old strongman last week labelled “an idiotic, stupid, street woman.”

The MDC, which has also written to the Zimbabwe Electoral Commission (Zec) seeking an extension of the voter registration process to July 19, says the Registrar General’s office has also disenfranchised 300 000 voters in Harare alone.

The MDC secretary general said Youth Assembly deputy president Costa Machinaguta was shot at in a drive-by in the high density suburb of Budiriro on Wednesday.

“Violations and violence is on the increase. The chaos faction in Zanu PF is trying to reignite and remobilise the arsenal of violence...we can see a deliberate attempt to decimate our leadership,” said Biti.

Biti also raised concern with the 120 000 people from the ministry of Foreign Affairs who have applied for postal voting saying government does not employ such a staggering figure in foreign missions.

Mugabe is being advised by Madhuku, as part of a retribution agenda against MdcT. However Sadc has clearly stated that Mugabe was put in power by Sadc through negotiation after the inclusive 2008 elections. I can see fire and brimstone in August. Madhuku will only go a certain lenght, but not the whole distance.The Jews will rig the elections yes , but Mugabe's victory will be valid only in Israel.

True, Mugabe acted illegally and and rudely by telling off SADC. But the MDC should have forseen this. (I expressed the same views to some MDC officials some years back) ZANU(PF) will listen to SADC and the AU as long as they are singing a ZANU(PF) song. However it is time to focus on the forthcoming election and campain vigorously. The MDC has many campaign issues and must use them!

Mdc is going ahead with the election with vigor and at the same time Mugabe must be faught through the courts, SADC, AU , CHINA, Eu for the other issues he has not lived up to as required by the laws of the land. Cheating and deception by Mugabe has been discovered by all concerned and he must be taken to task on all these issues. The guy must never be allowed to sleep pearcefully even for one night from now on until he is history. The other parties are run by young guys and they have loads and loads of energy they must go for him both during election time and after. deny him peace like he is doing to all Zimbabweans. Drag him through all the dirty Zimbabwe, Africa and the world has. Make him miserable it has been his choice. We know the Con court said Elections on 31st July but we also know those who legitimised him told him to do certain things before the elections as those areas where the ones causing problems in our dear land . He agreed to do that but abdicated. He skemmed out with the help of Moyo Jona. Go for him boys with all your Vigor we are behind you. Campaign hard too.

A trained lawyer should not have blatant contempt of the Zimbabwean laws, as being rabidly displayed by Biti. Simply, if you don't want to partake in the Election simply boycott, because the Elections are a reality come 31 July 2013.

But on the other hand, it could be the strategy that Obama and that lame-duck-brain Zuma agreed during Obama's recent visit to South Africa. We are certainly going to see Zuma calling for an extra ordinary meeting of the SADC Troika on Zimbabwe and there after, pressure will be brought to bear on other SADC Heads of State to agree to attend a so-called extraordinary meeting on Zimbabwe in a vein attempt to derail an election that MDC is hearded for defeat. If this fails, as it is sure to, the MDC will boycott the election just before the polling day, claiming massive rigging, intimidation and a bag of other stupid excuses we have grown wearie of. Zanu Pf should be vigilant and make sure other nasty tricks in the MDC bag of tricks do not succeed. The West is quiet at the moment and this is when they are deadliest. I am sure they are up to something. The British and Americans have already seen that MDC is going to be defeated and they must be planning something. CIO should sniff it out and thwart whatever the imperialist devils are planning.POP
