HIV+ man caged 35 years for rape

HARARE - An HIV-positive Harare man who raped and infected two 10-year-olds with the virus has been sentenced to an effective 35 years behind bars.

Regional magistrate Fadzai Mthombeni had slapped Darlington Yolofasi, 43, with 40 years in prison but she set aside five years on condition of good behaviour.

Yolofasi was convicted of all three counts of rape despite pleading not guilty to the offence and sentenced to 20 years on all the counts.

His second and third count will, however, run concurrently.

In passing her sentence, Mthombeni said the matter was aggravated by the fact that Yolofasi was HIV-positive and he wilfully transmitted the disease to the kids.

“This is a very sad case where there are two innocent children condemned to death by the accused person’s behaviour,” she said.

Yolofasi and his two victims stayed at the same house in New Canaan, Highfield.

The court heard that sometime in 2012, Yolofasi, who was self–employed, asked the complainants’ aunt to let her nieces sleep in his room while he was going to work during the night.

He then handed over the key to his room to the girls’ aunt who, subsequently, instructed her nieces to sleep in Yolofasi’s room.

It is the State’s case that one of the victims slept on the bed while the other one was on the floor after which Yolofasi came back home during the night and got into his bed to sleep.

He woke the girls up and instructed them to strip off their clothes while he removed his own clothing and then raped them.

After the incident, he continued to rape the girls several times on different occasions.

After the matter came to light, a report was made to the police, leading to the arrest of the accused person.
