Chitungwiza Municipality faces $11 000 lawsuit

HARARE - Chitungwiza Municipality —  battling a $6m water debt owed to City of Harare — has been hit by another lawsuit after failing to pay for electrical goods worth over $11 000 acquired from a local firm.

The court heard that Chitungwiza Municipality entered into a credit facility with Frolgate Technology (Pvt) Ltd, a company in the business of procuring and distributing electronic equipment.

According to the agreement, Frolgate would supply Chitungwiza Municipality with computers and accessories.

The agreement stipulated that payment would be effected within 30 days.

Pursuant to the agreement, Chitungwiza Municipality was supplied with 36 HP desktops and 14 computer accessories worth $34 942 but failed to pay the full amount as agreed, prompting Frolgate to institute legal action.

Through an urgent chamber application filed before High Court judge Felistas Chatukuta, it was heard that Chitungwiza Municipality only paid $23 200 between November and December 2011, leaving a balance of $11 742.

According to the agreement that the two parties entered into, Chitungwiza Municipality had undertook to pay all legal costs in the event Frolgate instituted legal action for the recovery of the money.

The court heard that Frolgate wrote a letter to Chitungwiza Municipality to no avail.

“Despite demand, the defendant (Chitungwiza Municipality) has failed, refused or neglected to pay the outstanding amount,” reads part of the court papers. - Tendai Kamhungira
