HARARE - The deputy sheriff has attached two vehicles belonging to Chitungwiza North MP Fidelis Mhashu.

Mhashu, an MDC legislator, yesterday filed an urgent chamber application seeking to bar the deputy sheriff from attaching his Mercedes Benz and a commuter omnibus, following a court order entered in November last year.

In the application, Mhashu cited Wellington Asani, his former employee, Alfred Mamvura and the deputy sheriff as the first, second and third respondents.

“I will suffer irreparable harm if the deputy sheriff is not barred from removing my property, as I may not be in a position to recover the said property,” reads part of Mhashu’s application.

Mhashu, said he was seeking a rescission of the November judgment, which according to court papers was entered by consent through his lawyer.

“I was not aware of the judgment in the matter yet I filed all proceedings and even filed summary of evidence,” said Mhashu, referring to the ruling that was passed authorising the attachment of the property.

Mhashu also said he had not authorised his lawyer to consent to the attachment of the property.

“Instead of (the matter) proceeding to trial, I am advised my then legal practitioners filed a consent order and that was not shown or explained to me. I did not authorise them to consent to the judgment as I have a defence to the claim,” he said.
